1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “User”) and Jeevanee (“we,” “us,” or “our”), governing your access to and use of the Jeevanee platform, including all web and mobile applications, APIs, and related services (collectively, the “Service”).

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service. These terms apply to all users, including family members added to a household by the account holder.

2. Eligibility

You must be at least 18 years of age to create an account and use our Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Parents and guardians may add minor family members to their household, but must provide verifiable parental consent for processing children's data in compliance with the DPDPA, 2023. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

Jeevanee is a family Life OS that provides tools for health coordination, financial tracking, fitness monitoring, and wellness management. The Service includes:

• Health tracking: medication management, prescription OCR, dose logging, health records
• Financial tools: expense tracking, budget planning, savings goals
• Fitness and wellness: activity tracking, nutrition logging, wellness routines
• Family coordination: shared dashboards, caregiver access, real-time alerts
• AI-powered features: Family Concierge, health insights, cross-domain intelligence
• Community features: forums, feature requests, discussions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

4. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account information updated
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Obtain consent from family members before adding them to your household

You must notify us immediately at support@jeevanee.com if you suspect any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. User Content

5.1 Your Content

You retain ownership of all content you upload, create, or share through the Service (“User Content”), including health records, prescriptions, financial data, community posts, and family profiles. By uploading User Content, you grant us a non-exclusive, royalty-free license to use, store, display, and process your content solely for the purpose of providing and improving the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to use and share the content
• Your content does not infringe any third-party intellectual property rights
• Health data you upload is for your own family members who have consented to its inclusion
• Community posts do not contain unlawful, defamatory, or harmful material
• You have obtained consent from individuals whose personal information you include

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without prior notice. You may delete your own content at any time through the platform. We are not obligated to monitor User Content but may do so at our discretion.

6. Subscription and Payments

Certain features of the Service require payment. By purchasing a plan, you agree to the following:

• Free tier is available with limited features as described on our pricing page
• Paid subscriptions are billed monthly or annually as selected
• All fees are listed in Indian Rupees (INR) and inclusive of applicable taxes
• Payments are processed securely through third-party payment providers
• You may cancel your subscription at any time; access continues until the end of the billing period
• Refunds are handled on a case-by-case basis within 7 days of charge
• We reserve the right to change pricing with reasonable advance notice
• Failure to pay may result in suspension of premium features

7. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Upload false health or financial information intentionally
• Attempt to access other users' accounts or data
• Upload malicious code, viruses, or any harmful software
• Scrape, crawl, or use automated tools to extract data from the platform
• Reverse engineer, decompile, or disassemble any part of the Service
• Post harmful, abusive, misleading, or spam content in community features
• Impersonate another person or entity, or misrepresent your affiliation
• Use the Service for any purpose other than personal or authorized family use
• Share prescription or medication data of individuals who have not consented

9. AI-Powered Features

The Service includes AI-powered features such as prescription OCR, health insights, cross-domain intelligence, and the Family Concierge. By using these features, you acknowledge and agree that:

• AI outputs are generated suggestions and may contain errors or inaccuracies
• AI-generated content is always labeled and presented for your review before saving
• Your data may be processed by third-party AI services under data processing agreements
• AI outputs are not medical, financial, or legal advice
• You are responsible for verifying AI-generated information with qualified professionals
• You may opt out of AI features at any time without losing access to core functionality

10. Family Data Sharing

Jeevanee enables data sharing within family households. By adding family members:

• You confirm that you have obtained consent from each family member added to your household
• Household admins can view shared health, financial, and wellness data as configured by member permissions
• Caregivers may have limited permissions (e.g., log doses but not delete prescriptions) based on their assigned role
• Individual family members can control what data is shared and withdraw sharing consent at any time
• Removing a family member from the household revokes their access immediately

11. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the website design, text, graphics, logos, icons, images, software, and the Jeevanee brand — are owned by us or our licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws. You retain ownership of your personal data and User Content. By posting content in community features, you grant Jeevanee a non-exclusive, royalty-free license to display that content within the Service. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any of our intellectual property without our prior written consent.

12. Third-Party Services

The Service may integrate with or contain links to third-party services, including payment processors, AI processing providers, analytics tools, and external health information resources. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies. Third-party data processors used by Jeevanee are bound by data processing agreements that protect your information.

13. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any content, including AI-generated outputs, on the platform.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Jeevanee and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Jeevanee and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of a third party.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if you violate these Terms or engage in conduct that is harmful to other users or to Jeevanee. You may delete your account at any time through the platform settings.

Upon termination, your right to use the Service ceases immediately. Your data will be permanently erased within 30 days, except where retention is required by law. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@jeevanee.com. We will make good-faith efforts to resolve any dispute within 30 days.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page with a revised effective date, and through in-app notifications or email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
